6.Description of the contractThe contract comprises the design and construction of a 4,300 metres long wastewater forcemain, needed to transmit raw wastewater from the discharge of the Pump Station Pradera to the designated receiving site at the Wastewater Treatment Plant Las Esclusas. The pipe internal diameter is 1917 mm ±1% and must be installed using microtunneling (pipe jacking), The project is in an urban setting, at the South of the city of Guayaquil, Ecuador, near the Guayas river. The contract refers to all design and construction services required for full completion of the project: all civil works (receiving and starting shafts), provision and installation of the forcemain and all materials and electromechanical equipment, acceptance tests, and commissioning. Both, the quality of the design and construction services and the time for delivery of the project (24 months) are important.

8.Eligibility and rules of originParticipation in tendering is open on equal terms to all natural and legal persons (participating either individually or in a grouping (consortium) of tenderers).

9.Grounds for exclusionTenderers must submit a signed declaration, included in the Tender Form for a Works Contract, to the effect that they are not in any of the situations listed in point 2.3.3 of the Practical Guide.

10.Number of tendersTenderers may submit only one (1) tender for all the lots. Tenders for only one lot of parts of a lot will not be considered. Any tenderer may state in its tender that it would offer a discount if its tender is accepted. Tenderers may not submit a tender for a variant solution in addition to their tender for the works required in the tender dossier.

11.Tender guaranteeTenderers must provide a tender guarantee of US$ 1.500.000 dollars when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties.

12.Performance guaranteeThe successful tenderer will be asked to provide a performance guarantee of 10% of the amount of the contract at the signing of the contract. This guarantee must be provided together with the return of the countersigned contract no later than 30 days after the tenderer receives the contract signed by the Contracting Authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next cheapest compliant tender.

13.Information meeting and/or site visitNo information meeting is planned; however, its mandatory that the Tenderers visit the site before submitting their tender. The Tenders must register their visit to the site with EMAPAG EP.

14.Tender validityTenders must remain valid for a period of 180 days after the deadline for submission of tenders.

15.Period of implementation of tasksThe maximum time for total completion of the overall project is twenty-four (24) calendar months. Substantial completion (including acceptance test and commissioning) is required by November 30, 2019. Total completion must happen before or up to January 31st, 2020.

16.Selection criteriaPer the criteria used in Section 27 of the Instructions to Tenderers and Section III Evaluation and Scoring Criteria.The evaluation of the tenders will be based on the evaluation of the following criteria:i. Evaluation of compliance with the qualification criteriac. Evaluation of the technical proposald. Evaluation of the cost proposalIf the tenders are deemed non-complaint in any previous steps, it will be rejected and will not go to evaluation in the next step. The Contracting Authority will only evaluate the price proposals of the tenders that comply with all the formal, qualification and technical requirements.

17.Award criteriaLeast Price; however, as per Item 16, the tenders must comply with all the formal, qualification and technical requirements to qualify for the economic evaluation.

18.How to obtain the tender dossierThe tender dossier is available from in the www.emapag-ep.gob.ec web site.It is also available for inspection at the premises of the Contracting Authority, address as in point 5 above. Tenders must be submitted using the standard tender forms included in the tender dossier, whose format and instructions must be strictly observed.Tenderers with questions regarding this tender should send them in writing to uepmultilaterales@emapag-ep.gob.ec (mentioning the publication reference shown in item 1) at least 21 days before the deadline for submission of tenders given in item 19. The Contracting Authority must reply to all tenderers" questions at least 11 days before the deadline for submission of tenders. Eventual clarifications or minor changes to the tender dossier will be published at the latest 11 days before the submission deadline on the EuropeAid website at https://webgate.ec.europa.eu/europeaid/online-services/index.cfm?do=publi.welcome.

19.Deadline for submission of tenders16H00 EDT on October 2, 2017.Any tender received by the Contracting Authority after this deadline will not be considered.

20.Tender opening sessionA public opening session will be held to open the technical proposals at 16H00 EDT on October 2, 2017, at the Contracting Authority (EMAPAG EP) offices in Guayaquil, Ecuador.

21.Language of the procedureAll written communications for this tender procedure and contract must be in Spanish.
